All content on this website (text, photographs, reproductions of artworks, graphic elements, code) is protected by copyright and remains the exclusive property of Natacha BH / HubaNet SL, unless otherwise stated. Any reproduction, representation, modification, or use of this content, in whole or in part, without prior written authorization is prohibited and may be subject to legal action.

The sale of an artwork (original painting, print, or custom creation) transfers ownership of the physical item to the buyer, but does not transfer copyright or reproduction rights, unless otherwise agreed in writing.

 

4. Products and services offered

The website offers:

  • original paintings (Harmonic Paintings, Connect Paintings, Radiant Paintings, Luminous Variations, E-motion series);

  • paper prints;

  • custom-made paintings;

  • the Mov'In Art facilitation service, an intangible service offered by booking.

 

5. Orders and payment

Orders are placed directly on the website. Prices are shown in euros. Payment is secured and processed by the payment providers integrated into the Wix platform.

 

6. Right of withdrawal and returns

In accordance with EU consumer rights regulations (Directive 2011/83/EU, transposed into Spanish law through the Consolidated Text of the General Law for the Defense of Consumers and Users — Real Decreto Legislativo 1/2007, as amended), customers have 14 calendar days from receipt of the product to exercise their right of withdrawal, without needing to provide a reason.

To be accepted, a returned product must be complete, in its original packaging, and undamaged. Return shipping costs are borne by the customer, except in the case of a defective product.

Exception — custom creations: in accordance with Article 16(c) of Directive 2011/83/EU, custom-made paintings ("Connect Paintings", "Tailor-made Paintings") are goods made to the consumer's specifications or clearly personalized. They are therefore not eligible for the right of withdrawal and cannot be returned, except in the case of a genuine manufacturing defect.

Mov'In Art service: in accordance with Article 16(a) of the same Directive, once the service has been fully performed with the customer's prior express consent — who thereby acknowledges losing their right of withdrawal — it can no longer be cancelled or refunded.

 

7. Legal warranty of conformity

All products sold benefit from the legal warranty of conformity provided under Spanish law, set at three years from delivery since 1 January 2022 (Real Decreto-ley 7/2021, transposing EU Directive 2019/771). If a lack of conformity is found during this period, the customer may request repair, replacement, a price reduction, or termination of the sale, under the conditions set out by law.

Photographs of the artworks shown on the website are provided for indicative purposes; slight variations in color or texture compared to the actual artwork may occur, particularly due to screen display.

 

8. Personal data protection (GDPR)

In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on personal data protection:

  • Data controller: HubaNet SL, Plaça del Pedró 16, Pr 3, 08001 Barcelona.

  • Purposes: order and invoice management, responding to contact requests, and, with the customer's explicit consent, sending commercial communications.

  • Legal basis: performance of the sales or service contract; consent of the data subject for any commercial communication.

  • Retention period: for as long as necessary to manage the business relationship, then for the legal retention period applicable to accounting and tax records in Spain.

  • Recipients: only the technical providers necessary for the website's operation (hosting provider, payment providers). Data is never sold to third parties.

  • Rights: access, rectification, erasure, restriction of processing, portability, and objection, exercisable by email at natachabh.contact@gmail.com.

  • Complaints: if you disagree with how your data is processed, you may lodge a complaint with the Spanish Data Protection Agency (AEPD — www.aepd.es).
